Should a Rep Payee Recoup SSI Overpayments from a Previous Rep Payee?

  • July 26th, 2016
Q
I am the new Representative Payee for a Supplemental Security Income (SSI) beneficiary.  The beneficiary was overpaid for over a year and now the Social Security Administration (SSA) is seeking repayment.  When and how should I pursue the previous Rep Payee for reimbursement?
A

This is not your responsibility.  The SSA will obtain the funds from the previous Rep Payee or it will reduce the SSI beneficiary's award until the funds are repaid.
